Domestic Violence

Domestic violence is a unique crime because of the relationship between the defendant and victim. In order for a crime to be classified as domestic violence, the defendant and alleged victim have to be either roommates, blood relatives, married, or in a relationship.

More than other crimes, domestic violence often involves misunderstanding between two parties in a close relationship. However, the potential penalties for a conviction are severe: A one year intensive domestic violence batters treatment program that usually costs between $2,000 and $3,000; Loss of firearms rights; and possible jail time.

When the police visit a house after receiving a call reporting domestic violence, if they determine that an assault took place, they are required by Washington state law to arrest the primary aggressor.


Protection Order Violations / No Contact Order Violations

Protection orders and no-contact orders arrive in two different ways:

  • Protection Oders arise at the request of the petitioner in a court of civil jurisdiction where he/she alleges harassment or imminent fear of harm from the respondent.
  • A No Contact Order arises in a court of criminal jurisdiction where either (1) a judge prohibits all contact between the defendant and the alleged victim while the criminal case is pending or (2) a judge imposes a post conviction no contact order once a defendant either pleads guilty or is found guilty by a bench/jury trial.

Both protection orders and no contact orders restrict an individual from making contact with the protected party: No phone contact, no text messages, no third party contact, no physical contact closer than 100 yards from the protected party. Any violation of either a protection order or no contact order is punishable by up to one year in jail and up to $5,000 in fines.

Four Classifications of Assault

In Washington, the crime of assault is classified into four levels, based on severity of injuries and force used in the assault:

  • First degree assault – Class A Felony. Assault resulting in very serious injuries and bodily harm, including those produced by stabbing or a gun wound. Conviction results in 93-123 months in prison. Sentence is enhanced by 60 months if a firearm was used in the commission of the crime.
  • Second degree assault – Class B Felony. Assault resulting in substantial injuries and bodily harm such as broken bones. Conviction results in a minimum 3-8 months in prison without any prior offenses.
  • Third degree assault – Class C Felony. Assault resulting in non-debilitating injuries, such as those sustained by pushing and shoving.
  • Fourth degree assault – Gross misdemeanor. Assault resulting in minor injuries. Conviction results in up to one year in jail, $5,000 in fines, and two years active probation.
